If you are building a business for the long term, the brand should be treated as an asset from the beginning. Registering a trademark can protect the name, logo or other designation that helps customers distinguish your goods or services from those of another business.
Is trademark registration mandatory in Ukraine?
Trademark registration is not generally mandatory. A business may use an unregistered designation, but registration provides a clearer statutory right and a public record of the owner, the mark and the goods or services covered by the protection.
In Ukraine, the right to a trademark is certified by a trademark certificate. The legal scope is defined by the mark as registered and the list of goods and services in the register. The wording and Nice Classification classes selected for the application therefore matter as much as the logo or name itself.
What registration gives the owner
- The right to use the registered trademark for the covered goods and services
- A legal basis to prohibit unauthorised use of identical or confusingly similar designations in the cases provided by law
- A registered asset that can be transferred with a business or other transaction
- The ability to license the trademark under a licence agreement
- A clearer ownership record for investors, partners, marketplaces and enforcement work
Protection against unauthorised use
A third party may adopt an identical or similar name, logo or sign for related goods or services and create a risk of confusion. A registered trademark gives its owner a defined legal basis for objecting to that use and seeking the remedies available under Ukrainian law.
This is particularly relevant for businesses that invest in marketing, trade online, plan a franchise or licensing model, or expect to enter new product categories. Early clearance work is also valuable: it can identify conflicting applications or registrations before substantial money is committed to a brand that may be difficult to protect.
A trademark can become a business asset
Trademark rights may be transferred to another person or company and may be licensed for use, subject to the relevant agreement and registration requirements. A registered mark can therefore form part of a company's intellectual property portfolio and be considered in investment, restructuring, sale or succession planning.
Can foreigners register a trademark in Ukraine?
Yes. Foreign individuals and foreign companies may own and apply for Ukrainian trademarks. Applicants who have their permanent residence or permanent location outside Ukraine exercise their rights in relations with the Ukrainian National Office for Intellectual Property and Innovation through a registered intellectual property representative, commonly called a patent attorney, as required by Ukrainian law.
The filing strategy should still be checked case by case. It may involve a national Ukrainian application or, where suitable, an international registration designating Ukraine under the Madrid System.
What the application contains
- An application for registration
- A representation of the word, logo or other designation to be protected
- A list of goods and services grouped under the Nice Classification
- Applicant and representative details, together with any additional documents required for the case
- Payment of the applicable filing fees
The practical registration process
- Clearance search: review earlier Ukrainian marks and other relevant conflicts
- Scope: decide which version of the mark and which goods or services require protection
- Filing: prepare and submit the application to the Ukrainian IP Office
- Examination: the IP Office checks formal requirements and whether the designation qualifies for protection
- Registration: after a positive decision and payment of the required fees, the mark is entered in the register and the certificate is issued
Ukrainian legislation does not set one fixed examination period for every trademark application. The Ukrainian IP Office currently reports an average examination time of around 18 months. Objections, oppositions, requests for clarification or a complex list of goods and services can make an individual case longer.
How long does trademark protection last?
A Ukrainian trademark certificate is valid for 10 years from the filing date. The owner may renew it for further 10-year periods, subject to a timely request and payment of the applicable fee.
Why register before the brand becomes valuable?
Registration is usually easier to plan before a name is printed on signage, packaging and advertising. A focused search, a carefully drafted specification and the correct ownership structure reduce the risk of paying to rebrand later. For foreign applicants, we can coordinate the Ukrainian legal and filing work, including a registered patent attorney where the procedure requires one.
